Liability Waiver:
I hereby affirm that I am in good physical condition to exercise. My participation is purely voluntary and in no way mandated by The Swim Lab Asia Ltd. Also, I understand that I can stop training anytime if I have any discomfort or even without any particular reason. In no event shall The Swim Lab Asia Ltd, its officers, employees, or agents be held liable for any injury, death or property loss which I may suffer during the activities if caused by either my own negligence, inadequacies in health and fitness, or by accident.
Cancellation Policy:
As we have a new Pay As You Go (PAYG) system in place where you will only be charged for sessions that you attend, all clients will be required to adhere to our Cancellation Policy 3hrs for Training Squads, 72hrs for Courses, Clinics or Workshops, 5-days for Video Analysis or Private Appointments. This will ensure that you are not charged for a session you have cancelled early, while at the same time, affording anybody on the wait list the opportunity to attend instead. If you cancel late, you will be charged in full. We thank you for your understanding.
Purchase Policy:
Please note that all multiple session passes carry fixed validity dates:Drop Ins expire 14 days from the date of purchase 10 Session Swim Pass expires 90 days from the date of purchase 20 Session Swim Pass expires 90 days from the date of purchase. Courses expire at the end of the calendar month for which the Course takes place. There is a no make-up / no refund policy for any missed sessions once a course has commenced.Once a purchase has been made, the client will agree to abide by our Returns / Refunds policy.
RETURN & REFUND POLICY:
The Swim Lab Asia operates on a Pay As You Go system for Swim Squads. As a general rule, any refunds, if honoured, will be refunded into the Clients Account for use towards future purchases. Returns or refunds will be dealt with on a case by case basis, but generally only honoured under extraneous circumstances such as, but not limited to:
Injury, preventing client from continuing
Relocation, preventing the client from continuing
Any change to specific appointments or courses whereby the service offered by The Swim Lab can no longer be honoured.
Any closure of facilities that is our of our control.
Clients who find they have accidentally purchased more Passes than required or who cannot complete their Sessions within their Passes prior to their expiration date may request a return, which will be at the sole discretion of the Director, minus any fees associated with Third Party payment processing systems.
INCLEMENT WEATHER POLICIES
Those signed up for any session affected by bad weather will be sent an WhatsApp message to announce any changes. Where possible participants will be contacted of cancellations at least 45mins prior to the session. If a session is cancelled, you will not be charged.
In general, the following practices will be adhered to. If in doubt, please use your best judgement:
Black Rainstorm Warnings
Unless there is a government warning which prohibits the running a session, it will be safe to assume the session will take place.
Thunder and Lightning
The HK Observatory generally issues territory wide blanket warnings, where sometimes the bad weather is far away from the venue. As such, there is a possibility of a sessions going ahead if the bad weather is a safe distance away from the venue. Participants will be notified if sessions are to be cancelled but please also exercise your best judgement. The observatory also offers this handy link to check for lighting based on proximity.
Typhoon 8 and Above
All sessions will be cancelled. Coached sessions will only resume if the signals are lowered T3 or below, 3 hours prior to the scheduled start of the session.
